TOPOGRAPHICAL METHOD USED IN SETTLEMENT OF DISPUTES REGARDING DEGRADATION OF SOME PROPERTIES

The paper refers to the way in which some conflicts between the complainants and a mining operator were solved. The mining company had built a dump on a valley and after a short time, several houses and land were damaged. Although the possessions were at a considerable distance from the stockpile, the owners accused that the groundwater and soil water flow was changed after dump construction. The mining company was sued. The court requested an expertise to determine the true cause of degradation homes and verify the extent to which mine operator is culpable. In this expertise, geotechnical, hydrological and other studies were done but in elucidating the case, the best arguments came from topographical analyzes. By comparing maps obtained from aerial photogrammes at different moments it was found that in past there have been landslides even before the mining company to perform works in the area. From the comparison of topographical plans it was found also that there are other areas where this phenomenon happened without mining works in the area. The findings from the maps were then confirmed by observations made on the ground in other areas.
