ENSURING ENVIRONMENTAL SAFETY FROM THE PERSPECTIVE OF THE PROTECTION OF THE NATIONAL INTERESTS OF THE STATE

Abstract

Today the issue of environmental safety has spread into almost all branches of knowledge, including legal. That has certain objective grounds, which are shown mainly in the crisis aggravation of the processes taking place in society and nature, which can be solved only by joint efforts of the entire world community [1]. And it is no coincidence, because the environmental factor is increasingly affecting the evolution of the state. Irreversible changes in the natural environment as a result of human economic activity went out of separate territories and began to acquire global scale. In addition, the effectiveness of the protective mechanism to ensure environmental safety due to a number of economic and social circumstances is extremely low despite the state support. There is no unified system of effective management of natural resources, no reliable legal and economic basis for environmental protection and environmental safety. The fact that Russia is member of many international organizations imposes certain obligations on the state in the field of ensuring the environmental rights of citizens and developing a state environmental strategy. The problem of environmental protection and environmental safety is considered by legal scholars as one of the main and permanent functions of the state. Taking into account the importance of developing this problem it is required considerable efforts both from practitioners: judges, prosecutors, police officers and from legal scholars. Also relevant is the issue of environmental forecasting as a function of management in the field of environmental protection, which is interesting not only from a scientific but also practical point of view. First of all, it is important to analyze the content of environmental forecasting in terms of ensuring environmental safety, as well as the definition of criteria for separating this function from other management functions in the field of ecology. Today the interest in the theoretical and practical problems is growing naturally and deserving close attention of scientists. However, it is obvious that environmental problems have not sufficiently studied in the legal literature yet. Perhaps this is why, neither in science nor in law there is a single term to denote the concept of "environmental security".
