COMPARATIVE ANALYSIS OF SLOVAK AND CZECH CONSTITUTIONAL LAW ON FAVORABLE ENVIRONMENT

Abstract

The right to a favorable environment advocates the theory of law in the third generation of human rights that emerged in the second half of the twentieth century. Its creation required the need to protect the population from the threats posed by the postmodern era and the post-industrial society. This category is a generation of collective rights based on people's solidarity and the pursuit of a favorable environment. In international discussions, third-generation rights are controversial and not widely recognized. In today's world, their enforcement is quite complex. Probably for this reason, the issue remains on the verge of legal theory. We strive to review it. We primarily focused on constitutional aspects of this right. Through scientific and doctrinal explanation, we examined selected articles of the Constitution of the Slovak Republic relating to the issue of the right to a favorable environment and the protection of cultural heritage. Through scientific literature and case law, we are looking for answers to some application problems from legal practice. Last but not least, we compare the Slovak constitution with the Czech one and point out the differences. The result of the paper is the review of constitutional aspects of environmental protection in the Slovak Republic and their comparison with the Czech legislation. The contribution focuses primarily on the area of constitutional law with significant overlaps into administrative and environmental law.
