CURRENT ISSUES OF INDUSTRY ENVIRONMENTAL SELF-CONTROL LEGAL NATURE IN UKRAINIAN ENVIRONMENTAL LAW DOCTRINE
Abstract
The article is devoted to the issues of industry environmental self-control legal nature which is traditionally considered one of the forms of environmental control by the Ukrainian environmental law doctrine. The urgency of improving the efficiency of law in this area is due to the authors` contention, according to which environmental control is one of the most promising guarantees for ensuring environmental safety of the environment and human beings by preventing and minimizing the negative impact of environmental activities on the part of business entities. Authors would like to emphasize that the environmental self-control serves as a way of protection in case to prevent the emergence of various kinds of environmental disasters, tecnogenic accidents, etc. One of its main tasks is to prevent environmental emergencies of tecnogenic and natural character. However, from a legal point of view, the environmental self-control is a complex and under-researched legal doctrine phenomenon. As one of the forms of environmental control, the industry environmental self-control simultaneously is an integral part of the production (economic) activity of enterprise. This determines the complex nature of legal relationships that arise in this field and include both the economic regulation, i.e. the organization of environmental management, as well as the sphere of enterprise relations with the authorized state authorities: their licensing, certification, establishment of environmental standards, application of liability measures to enterprises and others. The environmental self-control implementation should be a prerequisite for the work of any economic entity whose activities have a negative impact on the environment. The authores concluded that as a system of legal rules of different legal force and sectoral affiliation, which regulate its basic principles and forms of implementation, the environmental self-control may be considered as an integrated legal interdisciplinary institute of environmental law.
