Abstract

Environment Protection is becoming part of the international and national legislation on human rights. The link between the environment protection and human right is the focus of such paper. Alongside, the paper will raise also the question of environment protection as dispensable mean for the protection of one fundamental right such as the right to life. Indeed, the debate about the relationship between the environment protection and human right at international level is going on for more than forty years. Moreover, the legislation has been developed also on this regard at international level and at certain degree at national level. The development of such legislation in all the countries is very important considering the fact that the environment protection depends not only on one country but also on neighboring counties. The present paper will analyze the existing constitutional national legislation of Western Balkan countries as candidate and potential candidate countries to join the EU in order to identify the need for legal intervention on those countries for the purpose of recognizing the link between environment protection and human rights and foreseeing explicitly the environment protection as human right.
