THE ACHIEVING OF CADASTRAL DATA BANK FOR REAL ESTATES INTENDED ON RESTITUTION ACTIONS

Abstract

The latest law in matter of property right, which aims to be a solution to solve the problems arising during the implementation of previous property laws, is Law no. 165/2013 concerning the measures to complete the process restitution, in the nature or equivalent, of the real estates abusively taken during the communist regime in Romania. The complexity of the previous laws regarding the restitution of properties abusively taken, as well as the changes produced upon them over the time, imposed the adoption of a new law which will allow the resolution of all restitution claims that that have not been solved. The practical application of the Law no. 165/2013 and its implementing rules involves the creating of a cadastral database which allow the identification of all real estates that may be subject to the process of restitution, situation in which the Law 165/2013 was intended to be a law to allow the adoption of concrete measures to complete the process of restitution of properties abusively taken.
