Abstract

After the adoption of the Law no. 221/2015 and the new Code of Contracts, Legislative Decree no. 50/2016, Italy has become the first European country that has imposed Minimum Environmental Criteria (MEC) thus amplifying the importance of Green Public Procurement (GPP), already widespread in Europe since the late 90's in a totally voluntary way. In Italy, MEC have been approved with specific Decrees by the Ministry of the Environment and concern numerous areas of intervention (mainly as regards the supply of goods and services). In terms of public works, the Decree with the greatest impact is those on Construction, MD. 24.12.2015, updated by 11.1.2017 пїЅMinimum environmental criteria for design and works services in new construction, renovation and maintenance of buildingsпїЅ. This paper focuses on пїЅTechnical specifications of the buildingпїЅ criteria (Section 2.3 of MD.) and simulates the application of MEC requirements to two cases of new public works: a residential building and a primary school. Starting from the contents of the executive project based on the invitation to tender, it is verified that each criterion and/or its level of applicability is respected, with the aim of determining the variation in relation to the construction costs. In order to assess the real impact of the measure, the effects of the intervention on the useful life of the asset are also taken into account, examining possible advantages and/or disadvantages for the contracting authority in terms of maintenance costs and energy savings.
